What are Medical Experts?
One of the most important figures in the area of criminal investigation is the expertise, through the analysis or expert investigation we can obtain reliable and objective information, obtained through the application of different scientific methods and specialized techniques that can be offered as evidence in the different judicial processes.
The concept of expert, in general terms, refers to persons qualified by reason of their technical science, trade or specialized knowledge, since there are handwriting, graphological, linguistic, criminal, computer, economic, and medical expert reports, among others. In the area of medicine, there is the figure of the forensic and legal medical expert, with knowledge of medical sciences, forensic medicine, psychiatry, criminology and legal sciences, although there are areas of specialization. Their intervention as official experts is given under the designation of a Judge of the Public Prosecutor’s Office, either of a victim or as an assistant to the representative of society.
The medical expert generally intervenes in special cases to determine the responsibility of an act that caused an injury or the death of a patient, his intervention is decisive in a case, since the judge will only take into account the expert’s opinion, even if the case is supported by reports from medical specialists, since the expertise is based on impartial forensic reports, with special criteria that may differ from those of the medical specialists.
Medical Forensic Experts in Mexico
In Mexico, forensic medical experts represent the first work force within the Forensic Medical Service (SEMEFO), whose main function is the practice of necropsies, examinations and medical-legal documents supported by a previous request or office, with corresponding numbers and signatures, in order to carry out the process of investigation of each case.
Let us remember that the purpose of a necropsy is to determine the type, mechanism and causes of death, if there are reasons with pre-existing, simultaneous or supervening causes, in addition to providing complementary data to the case; besides analyzing the injuries, samples of blood, urine and other substances, tissues and radiological images are taken, if necessary. To endorse the veracity of the report, two signatures of official forensic medical experts are required, present at the assessments; the medical experts may request radiological, toxicological, histopathological or psychiatric examinations according to their criteria or at the request of the authorities.
